Formation of Contract: The Applicant or the Agent, if the Agent is submitting this Berth Application form on behalf of the Applicant, agrees that by submitting this Berth Application to Kimberley Ports Authority, it will be irrevocably bound by a contract that is formed pursuant to and containing all of the terms and conditions in the Port Standard and Procedures as amended by Kimberley Ports Authority from time to time.

Moorings

All moorings within KPA port limits, at any of the ports (Broome, Derby, Wyndham and Yampi Sound) are privately owned and it is an offence under the Port Authorities Regulations 2001 to use a mooring without the permission of Kimberley Ports Authority (Penalty $5,000). Permit to Work Systems

KPA has a Permit to Work system to control types of work that are potentially hazardous. KPA’s Permit to Work Procedure specifies the permits required to conduct various activities and outlines the process for applying for and the issuing of permits.

All activities requiring permits should be submitted to and authorised by the Operations department. Some permits can be completed online (see bolded links below) and other permits are to be provided to the Operations department, or via e-mail to: derbyoperations@kimberleyports.wa.gov.au.

Bunkering and Refuelling Services

Fuel bunkering at Derby Wharf is undertaken by service providers licensed by Kimberley Ports Authority (KPA). For a current list of approved bunkering providers and their contact details, please contact KPA directly on (08) 9194 3100 or derbyoperations@kimberleyports.wa.gov.au for permit to work queries.

Weather and Tides

The Kimberley region has a tropical climate with hot and humid summers and warm winters. From October to April maximum temperatures average over 33C, while the overnight minimum is typically 26C in the wet/summer months.By contrast winters are mild, in July average maximum and minimum temperatures being 26.9C and 12.0C respectively.

Over 75% of the average annual rainfalls from January to March are associated with thunderstorms and tropical lows or cyclones. These weather systems can produce heavy rain in short periods.The unreliable nature of the occurrence and movement of thunderstorms and tropical systems result in rainfall being highly variable.
Tropical cyclones capable of strong winds, high seas and heavy rain can be experienced during the months from November to April but are most common in January and February.

KPA’s Cyclone Contingency Procedure is reviewed by the Harbour Master prior to the cyclone season each year and updated to reflect changes necessitated by ‘lessons learnt’ from previous cyclone seasons or by changes to the Port’s infrastructure or operational practices.

The Port of Derby experiences large tidal variations, and port operations are scheduled around tide heights/movements.
